Terms of Use
These Terms of Use ("Terms") are an agreement between you and HackSonDev, LLC ("we", "us") for the use of PokePOS, our mobile point-of-sale app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you use PokePOS on behalf of a business, you agree to these Terms for that business and confirm you are authorized to do so.
1. The Service
PokePOS lets a business sell with cash or cards, manage items and inventory, and invite a team of sellers. A business "owner" creates the business and controls its settings, subscription and team. "Sellers" are people the owner invites; they can sell and see their own sales.
2. Accounts
You must be at least 18 years old and provide an email address you control. You are responsible for activity under your account and for keeping your email account secure. Owners are responsible for who they invite and for removing sellers who should no longer have access.
3. Card payments
Card payments, including Tap to Pay, are processed by Stripe. To accept cards, a business must create and verify a Stripe account and agree to the Stripe Connected Account Agreement, which includes the Stripe Services Agreement. Payouts, chargebacks, disputes, refunds and Stripe's fees are governed by those terms. We are not a bank or payment processor, we do not hold your funds, and we do not charge a fee on your sales. Tap to Pay on iPhone is subject to Apple's terms, which the owner accepts once for the business.
4. Subscriptions
New businesses get a free trial. After the trial, continued use requires a paid subscription, purchased in the app through the Apple App Store or Google Play. Plans are priced by the number of active sellers and are shown in the app before purchase.
- Payment is charged to your Apple ID or Google Play account at confirmation of purchase.
- Subscriptions renew automatically at the end of each period unless canceled at least 24 hours before the period ends. Your account is charged for renewal within 24 hours before the end of the current period.
- You can manage or cancel your subscription in your Apple ID or Google Play account settings. Canceling stops future renewals; it does not refund the current period.
- Refunds are handled by Apple or Google under their policies.
If a subscription ends or a payment fails, the business may be limited to read-only access until a plan is active again. Your data is not deleted because a subscription ends.
5. Your responsibilities
You are responsible for your business, including the prices you set, the taxes you charge and pay, receipts and records you must keep, refunds to your customers, and compliance with the laws that apply to your business. Sales tax amounts in PokePOS are calculated from the rate you enter; we do not provide tax advice.
You agree not to use the Service to sell illegal goods or services, to commit fraud, to process payments for someone else's business, to interfere with or reverse engineer the Service, or to access data you are not authorized to see.
6. Your content
You own the information you put into PokePOS, such as items, photos and sales records. You give us permission to host, process and display it only to provide and improve the Service for you. You are responsible for having the rights to the photos and content you upload.
7. Availability and changes
We work to keep PokePOS available, but the Service may be interrupted for maintenance, updates or reasons outside our control, and some features depend on your device, network connection and third parties such as Stripe, Apple and Google. We may change or discontinue features; if we make a change that significantly reduces the Service for paying businesses, we will give notice in the app or by email.
8. Suspension and termination
You can stop using PokePOS at any time and delete your account in the app (More → Delete account) or by writing to support@pokepos.com. We may suspend or end access if you seriously or repeatedly break these Terms, if required by law, or to protect users, customers or the Service. Where reasonable, we will give notice first.
9. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the Service will be error-free or uninterrupted.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim related to the Service is limited to the amount you paid us for the Service in the 12 months before the claim.
11. Indemnity
You agree to defend and indemnify HackSonDev, LLC against claims arising from your business, your sales, your content or your violation of these Terms or the law.
12. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Delaware, and both parties consent to their jurisdiction. Nothing here limits rights you have under laws that cannot be waived.
13. Apple
If you downloaded PokePOS from the App Store, you acknowledge that these Terms are between you and HackSonDev, LLC, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support, and is not responsible for any claims relating to the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple's Standard EULA also applies to your use of the app, except where these Terms provide otherwise.
14. Changes to these Terms
We may update these Terms. If a change is significant, we will notify owners in the app or by email before it takes effect. Continuing to use the Service after the effective date means you accept the updated Terms.
